chatubate.net Inc. (hereinafter referred to as "chatubate") provides webcam video broadcating and communication services for individuals, businesses and organizations.
All webcams and communications delivered through the chatubate Web site and network are the sole responsibility of the broadcaster an/or author. chatubate IS NOT RESPONSIBLE FOR THE CONTENT OF ANY BROADCASTS AND/OR COMMUNCIATIONS.
Individual broadcasts transmitted through the chatubate network are segmented into two separated areas.
- General Area: chatubate requires that all users, broadcasters and chat participants in the GENERAL VIDEO CHAT AREA broadcast video images and
post chat messages that are suitable for mainstream audiences [pg] and that are not generally considered objectionable or offensive. chatubate will remove any video and/or chat discussions that are found to be in violation of this policy.
chatubate does not permit unauthorized advertising within broadcasts and/or chat and specifically prohibits attempts to promote
other Web sites through video broadcasts and chat.
chatubate reserves the right to remove without notice any content communicated by any user(s) for any reason.
chatubate has no obligation to delete, remove or modify any content.
- Open Area: chatubate requires that all broadcasters and chat participants observe the laws and regulations of
all local, national and international goverments and agencies having juristiction.
chatubate does not permit unauthorized advertising within broadcasts and/or chat and specifically prohibits attempts to promote
other Web sites through video broadcasts and chat.
chatubate reserves the right to remove without notice any content communicated by any user(s) for any reason.
chatubate has no obligation to delete, remove or modify any content.
chatubate may terminate any user's access to the network, Web site and service and remove any content posted, for any reason.
chatubate reserves the right to modify or discontinue and portion or component of the service at any time and
with or without notice.
chatubate shall not be liable to any user or any third-party for any termination or modification of service.
chatubate does not claim ownership of any content communicated by users. By placing content on the site, you grant chatubate a
worldwide, royalty-free, non-exclusive, perpetual, irrevocable, fully paid up license, with full rights to grant sub-licenses, to use,
reproduce, modify, adapt, translate, create derivative works from, distribute, perform, display and publish the content, in whole or in part,
on the site and/or to incorporate it in other works in any form, media or technology now known or later developed.
SPEEDSTER SERVICE
chatubate accepts American Express, Discover, Mastercard and Visa. Monthly billing will be processed on the date of the upgrade purchase and will continue each month,
processed at the start of each monthly period for the duration of time that the account remains active.
chatubate bills based on a calendar month and in advance of service.
Accounts are considered past due if credit card processing is not approved by the bank or processing company.
Delinquent accounts are notified by e-mail. Delinquent accounts may be locked. If an account has been locked, you will not be able to access Speedster services until the balance has been paid.
After 30 days, locked accounts that have not been paid may be deleted from the system. Prices and conditions are subject to change without prior notice. To manage or cancel your chatubate Speedster
account, go to the my settings page - after logging in, there will be a button labeled "Speedster Settings" that will enable you to cancel your account. If you are dissatisfied with your Speedster service, please contact support@chatubate.net within 7 days of sign-up for a full refund.
SOFTWARE AVAILABLE ON THIS SITE
Any software that is made available to download from this server ("Software")
is the copyrighted work of chatubate and/or its suppliers. Use of the
Software is governed by the terms of the end user license agreement, if any,
which accompanies or is included with the Software ("License Agreement"). An
end user will be unable to install any Software that is accompanied by or
includes a License Agreement, unless he or she first agrees to the License
Agreement terms.
The Software is made available for downloading solely for use by end users
according to the License Agreement. Any reproduction or redistribution of the
Software not in accordance with the License Agreement is expressly prohibited
by law, and may result in severe civil and criminal penalties. Violators
will be prosecuted to the maximum extent possible.
Without limiting the foregoing, copying or reproduction of the software to
any other server or location for further reproduction or redistribution is
expressly prohibited.
The software is warranted, if at all, only according to the terms of the
license agreement. Except as warranted in the license agreement, chatubate
hereby disclaims all warranties and conditions with regard to the
software, including all implied warranties and conditions of merchantability,
fitness for a particular purpose, title and non-infringement.
RESTRICTED RIGHTS LEGEND
Any Software which is downloaded from this Server
for or on behalf of the United States of America, its agencies and/or
instrumentalities ("U.S. Government"), is provided with Restricted Rights.
Use, duplication, or disclosure by the U.S. Government is subject to
restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in
Technical Data and Computer Software clause at DFARS 252.227-7013 or
subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted
